Personal Injury Update: Whiplash Reforms Postponed Until April 2021

Due to the unprecedented impact of COVID-19, the Government has taken the decision to suspend the implementation of the Civil Liability Act 2018 until April 2021.

The Civil Liability Act 2018 will bring about several legislative changes to personal injury law, primarily in connection with 'whiplash' injuries in road traffic accidents. We previously wrote about these changes in our article titled 'The Future of Personal Injury for Claimants', which you can find here.

The Government had already postponed the implementation of the reforms until August 2020, however, it has now decided to further postpone the reforms after consulting with key stakeholder groups.

It is possible that the Government will delay implementing the reforms further, depending on the duration of the impact of COVID-19, and it will no doubt provide further updates in due course.
