Financial settlements can be the most complex part of a divorce, but they don’t have to be. If an agreement can’t be reached, the Court may make a decision based on the financial needs and resources of both parties, with the best interests of any children as a top priority. A financial settlement does not automatically go to Court; mediation (MIAM) is typically required first. Once an agreement is made, the Court may approve it to ensure fairness. Alternative methods like collaborative law or arbitration can often resolve disputes without the need for a Court hearing.
